TÉRMINOS Y CONDICIONES DE USO DE “SENIORS FIRST”
Los presentes Términos y Condiciones Generales (en adelante los “TyCG”) regulan la descarga, acceso, navegación y uso de la aplicación móvil SENIORS FIRST y el Sitio Web https://caregivers.seniorsfirst.care (en adelante, denominadas conjuntamente, la “Plataforma”).
Los presentes TyCG están dirigidos tanto a los usuarios registrados en la Plataforma como a cualquier otro usuario que acceda, navegue o utilice la Plataforma de cualquier forma.
En cumplimiento con el deber de información recogido en el artículo 10 de la Ley 34/2002, de 11 de Julio, de Servicios de la Sociedad de la Información y del Comercio Electrónico, le detallamos a continuación los datos del titular de la Plataforma:

El acceso y/o o uso de la Plataforma le atribuye la condición de usuario y acepta, desde dicho acceso y/o uso, los presentes TyCG.
Los usuarios (en adelante, los “Usuarios” o, en singular, el “Usuario”) pueden ponerse en contacto con SENIORS FIRST a través de la siguiente dirección de correo electrónico: dataprotection@seniorsfirst.care
La Plataforma está destinada a poner en contacto a profesionales dentro del sector de cuidados sociosanitarios con personas que precisan de los servicios de estos profesionales.
SENIORS FIRST únicamente presta la Plataforma para acercar tanto al Usuario que ofrece sus servicios en la Plataforma (en adelante, el “Usuario” y/o el “Usuario Cuidador”) como al Usuario que publica en la Plataforma ofertas de empleo y esté interesado en contratar tales servicios (en adelante, el “Usuario Contratante” y, en conjunto con el “Usuario Cuidador”, los “Usuarios”).
Se deja expresa constancia de que SENIORS FIRST únicamente pone a disposición de sus Usuarios, a través de la Plataforma, un espacio virtual de vinculación (en adelante, el “Servicio”).
En caso de que uno o más Usuarios o algún tercero inicien cualquier tipo de reclamación o acciones legales contra algún Usuario, todos y cada uno de los involucrados en dichas reclamaciones o acciones eximen de toda responsabilidad a SENIORS FIRST y a sus directores, gerentes, empleados, agentes, operarios, representantes y apoderados.
El Servicio se limita a la puesta a disposición de una plataforma tecnológica que permite a sus Usuarios vincularse de manera inmediata y así poder suplir las necesidades de unos con los servicios de la contraparte.
Por lo tanto, SENIORS FIRST no asume ninguna responsabilidad más allá de la referida vinculación entre los Usuarios a través de la Plataforma.
El Usuario Contratante conoce y acepta que al realizar operaciones con otros Usuarios o terceros lo hace bajo su propio riesgo y responsabilidad, y que hará una evaluación de los riesgos en los que incurre al contratar los servicios ofrecidos por el Usuario Cuidador escogido, guardando la debida proporción entre el riesgo y el medio seleccionado.
El acuerdo y vinculación entre los Usuarios no crea ningún contrato de sociedad, de mandato, de franquicia o relación laboral entre SENIORS FIRST y los Usuarios. Los Usuarios reconocen y aceptan que SENIORS FIRST no es parte en ninguna operación, ni tiene control alguno sobre la calidad, seguridad o legalidad de los servicios requeridos, o la capacidad o idoneidad del Usuario Cuidador para prestar dichos servicios.
Los TyCG, así como las Políticas de Privacidad y/o informaciones sobre la Plataforma se aplican a todos los Usuarios de la Plataforma desde el primer momento en el cual acceden a la misma. Los presentes TyCG tienen carácter obligatorio, vinculante y son aplicables a todas las actividades realizadas en la Plataforma. Si los Usuarios no desean someterse de forma íntegra a lo dispuesto en los presentes TyCG y las Políticas de Privacidad, deberán abstenerse de utilizar la Plataforma.
Los Usuarios son responsables de asegurarse de que todas las personas que accedan a la Plataforma a través de su conexión a internet conozcan y cumplan con los TyCG.
SENIORS FIRST declara y manifiesta que pone a disposición el Servicio de una Plataforma tecnológica la cual permite a sus Usuarios vincularse entre ellos y acercar el servicio de cuidados sociosanitarios que ofrece el Usuario Cuidador al Usuario Contratante y/o la solicitud de cualquier Usuario Contratante de dichos servicios.
Los Usuarios declaran que dicha intervención y/o vinculación a través de la Plataforma no generará para los Usuarios ningún tipo de vinculación laboral con SENIORS FIRST.
Mediante la aceptación de los TyCG, los Usuarios se comprometen a actuar en todo momento de conformidad con las disposiciones establecidas en el clausulado del presente texto legal. En caso de no estar de acuerdo con todo o parte de estos TyCG, los Usuarios deben abstenerse de instalar y utilizar la Plataforma.
El servicio prestado en esta Plataforma se rige por: (i) estos TyCG; (ii) Condiciones Particulares que puedan publicarse en la Plataforma; y (iii) las leyes vigentes y aplicables, regulaciones sectoriales y los criterios y prácticas generales.
Al aceptar los presentes TyCG, los Usuarios manifiestan ser mayores de 18 años y tener capacidad plena para entender y aceptar el contenido de estos TyCG, así como capacidad legal para contratar y asumir obligaciones.
SENIORS FIRST se reserva el derecho a modificar la presentación, configuración y contenido de la Plataforma, así como también las condiciones requeridas para su acceso y/o utilización. El acceso y utilización de los contenidos y servicios tras la entrada en vigor de sus modificaciones o los cambios en las condiciones suponen la aceptación de las mismas.
El acceso a determinados contenidos y la utilización de los servicios pueden encontrarse sometidos a determinadas condiciones particulares que, según los casos, sustituirán, completarán y/o modificarán los presentes TyCG y, en caso de contradicción, prevalecerán los términos de las condiciones particulares sobre los TyCG.
Antes de utilizar, y/o solicitar dichos servicios específicos ofrecidos a través de la Plataforma de SENIORS FIRST, los Usuarios deberán leer atentamente las condiciones particulares creadas, en su caso, a tal efecto por SENIORS FIRST. La utilización, reserva y/o la solicitud de dichos servicios específicos, implica la aceptación de las condiciones particulares que los regulen en la versión publicada por SENIORS FIRST en el momento en que se produzca dicha utilización, reserva y/o contratación a través de la Plataforma.
La Plataforma ha sido desarrollada por SENIORS FIRST con la finalidad de proporcionar un servicio de puesta a disposición de una Plataforma de tecnología que permite a los Usuarios de la misma, vincularse de manera inmediata y así poder suplir las necesidades de uno con los servicios de la contraparte.
El Usuario Contratante podrá a través la Plataforma acceder a toda la información necesaria correspondiente a la misma. Desde allí podrá navegar e investigar en profundidad sobre su funcionamiento.
- Registro: Para poder utilizar los servicios de la Plataforma es necesario en el registro en la misma y la aceptación de los presentes TyCG. El registro en la Plataforma es gratuito. Para efectuar el registro en la Plataforma, el Usuario Contratante deberá crear una cuenta, facilitando su correo electrónico, datos personales básicos y escoger una contraseña de acceso a la Plataforma. En el caso que el Usuario Contratante utilice la Plataforma con un plan de pago asociado deberá proporcionar los datos de facturación y pago. En el momento del registro el Usuario Contratante deberá tener al menos dieciocho (18) años o la mayoría de edad aplicable en su lugar de residencia. Los Usuarios garantizan que sus datos serán exactos, actuales y veraces. SENIORS FIRST no puede garantizar la identidad de los Usuarios registrados, no siendo responsable de usos indebidos o no autorizados de un Usuario registrado por terceros. El Usuario Contratante registrado será responsable en todo momento de la custodia de su contraseña de acceso a su cuenta de Usuario, asumiendo en consecuencia cualesquiera daños y perjuicios pudieran derivarse de su uso indebido, así como de la cesión, revelación o extravío del mismo, debiendo informar inmediatamente a SENIORS FIRST en caso de que tenga motivos para creer que su código de acceso o contraseña ha sido utilizado de manera no autorizada o es susceptible de serlo. En cualquier caso, el acceso y/o uso de la Plataforma realizado bajo el código de acceso o contraseña del Usuario Contratante registrado se reputarán realizados por dicho Usuario, quien responderá en todo caso de dicho acceso y uso. Una vez que el Usuario Contratante haya creado una cuenta de acceso a la Plataforma tendrá acceso a un perfil donde podrá completar sus datos personales conforme a lo establecido en la Plataforma. SENIORS FIRST tiene derecho a solicitar algún comprobante y/o dato adicional a efectos de corroborar los datos personales de los Usuarios, así como de suspender temporal o definitivamente las cuentas de aquellos Usuarios cuyos datos no hayan podido ser confirmados, sin que ello genere derecho a indemnización en favor de dichos Usuarios. SENIORS FIRST tiene derecho a rechazar cualquier solicitud de registro o cancelar un registro previamente aceptado, sin que esté obligada a comunicar o exponer las razones de su decisión y sin que ello genere derecho a indemnización y/o resarcimiento alguno en favor de los Usuarios afectados. Una vez completado correctamente el registro en la Plataforma, el Usuario Contratante tendrá acceso a un buscador en el que deberá seleccionar los filtros ofrecidos para definir las características de la oferta que desea realizar. Tras seleccionar los filtros deseados, el Usuario Contratante deberá seleccionar la modalidad preferida para realizar una oferta de entre las que se exponen a continuación.
- Modalidad Find and Send (Búsqueda Directa): Mediante la selección de esta modalidad, el buscador ofrecerá a los Usuarios Contratantes uno o más resultados de Usuarios Cuidadores cuyos perfiles coincidan con los criterios de búsqueda seleccionados. Es posible que el buscador obligue a seleccionar unos filtros básicos mínimos para poder ofrecer resultados. En caso de que no existan perfiles coincidentes con los criterios seleccionados, la Plataforma recomendará repetir la búsqueda eliminando algunos de los filtros seleccionados y ofrecerá a los Usuarios Contratantes la realización de un proceso de selección personalizado por parte de SENIORS FIRST. En este caso, tras la realización del proceso de selección, el Usuario Contratante recibirá los resultados y podrá decidir enviar una oferta directa a los Usuarios Cuidadores que desee. Para poder enviar una oferta directa a alguno de los Usuarios Cuidadores que se muestren en la lista de resultados, el Usuario Contratante deberá disponer de al menos un (1) crédito o bono suficientes. Disponiendo de al menos un (1) crédito, el Usuario Contratante podrá enviar ofertas directas a tantos Usuarios Cuidadores como desee. Sin embargo, en el momento en el que uno de los Usuarios Cuidadores acepte la oferta, el Usuario Contratante no podrá ver posteriores aceptaciones de otros Usuarios Cuidadores que también deseen aceptar la oferta si no dispone de un (1) crédito por cada aceptación adicional que desee visualizar. Las ofertas directas que el Usuario Contratante envíe a cada Usuario Cuidador expirarán en el plazo de veinticuatro (48h) horas desde su envío. Por cada Usuario Cuidador que acepte la oferta recibida del Usuario Contratante, se consumirá un (1) crédito de los que el Usuario Contratante tenga disponibles en ese momento. En caso de que no disponga de créditos suficientes en ese momento, el Usuario Contratante no podrá recibir las aceptaciones hasta adquirir nuevos créditos en cantidad suficiente. Es posible también que los Usuarios Cuidadores que hayan recibido una oferta directa muestren su interés en la misma, pero condicionando su aceptación en relación con algún aspecto de la oferta (v. gr., fecha de inicio, horario, salario, etc.). En este caso, el Usuario Contratante recibirá una notificación informándole del interés manifestado por el Usuario Cuidador y tendrá la posibilidad de consumir un (1) crédito para poder iniciar una conexión con dicho Usuario Cuidador y comentar la condición manifestada por el Usuario Cuidador. En caso de no disponer de créditos suficientes, el Usuario Contratante no podrá iniciar dicha conexión. En caso de rechazo de la oferta por parte del Usuario Cuidador seleccionado, el crédito que el Usuario Contratante tuviera disponible no será consumido, por lo que podrá seguir utilizándolo para nuevas a ofertas a otros Usuarios Cuidadores, de conformidad con lo aquí expuesto.
- Modalidad Post (Publicar una oferta): Mediante la selección de esta modalidad, una vez seleccionados los filtros o criterios deseados (algunos de los cuales pueden ser requeridos), la Plataforma publicará la oferta del Usuario Contratante en el muro o perfil de aquellos Usuarios Cuidadores que coincidan con los criterios de búsqueda seleccionados por el Usuario Contratante. La publicación de la oferta bajo esta modalidad no tendrá ningún coste para los Usuarios Contratantes. Las ofertas así publicadas expirarán en el plazo de treinta (30) días naturales, que el Usuario Contratante podrá prorrogar por otros treinta (30) días naturales. Los Usuarios Cuidadores que reciban las ofertas de los Usuarios Contratantes tendrán la opción de registrarse en dicha oferta. En este caso, el Usuario Contratante recibirá una notificación informándole de que un Usuario Cuidador se ha registrado en su oferta y tendrá la opción de consultar su perfil. En caso de que desee iniciar una conexión con los Usuarios Cuidadores registrados en su oferta, el Usuario Contratante deberá consumir un (1) crédito por cada Usuario Cuidador con el que desee conectar. Asimismo, el Usuario Contratante tendrá la posibilidad de eliminar la oferta, duplicarla o editarla en cualquier momento.
- Modalidad Post (Publicar una oferta) y Find and Send (Búsqueda Directa): Los Usuarios Contratantes podrán también seleccionar al mismo tiempo las dos modalidades que se acaban de exponer, en cuyo caso su oferta se publicará en el muro o perfil de los Usuarios Cuidadores bajo las condiciones expuestas en el apartado anterior y, asimismo, obtendrá los resultados de los perfiles de los Usuarios Cuidadores que coincidan con sus criterios de búsqueda, a los que podrá enviar una oferta directa bajo las condiciones expuestas en el apartado 4.2.
- Créditos: Los Usuarios podrán adquirir créditos en la Plataforma mediante el pago del precio publicado en la Plataforma en el momento de la adquisición. El precio vigente de los créditos y productos disponibles en la Plataforma será el indicado en cada momento en la Plataforma junto a su descripción, siendo de acceso público en la misma para visualizarlo. Todos los precios se muestran en euros (salvo para la contratación en el territorio de Reino Unido, en el que los precios se mostrarán en libras esterlinas -GBP-), salvo indicación expresa en contrario. El precio mostrado es el precio final, quedando expresamente incluido el Impuesto sobre el Valor Añadido (IVA) y cualesquiera otros gastos aplicables. No obstante, a lo anterior, el precio final incluirá todos aquellos incrementos o descuentos que sean de aplicación, gastos repercutidos al usuario y gastos adicionales por servicios accesorios, medios de pago, etc. En cualquier caso, todos estos importes serán mostrados al usuario de forma desglosada durante el proceso de contratación. Los créditos ya adquiridos no se verán afectados por las variaciones de precios que puedan publicarse en la Plataforma con posterioridad a su adquisición. En caso de baja de la Plataforma por parte del Usuario, perderá automáticamente su derecho a utilizar los créditos disponibles que no hayan sido consumidos hasta ese momento.
- Bonos y promociones: SENIORS FIRST podrá ofrecer bonos y promociones a su libre discreción a los nuevos Usuarios que se registren en la Plataforma o a los Usuarios ya registrados, bajo las condiciones que libremente decida establecer. Los bonos y promociones, así como las condiciones y precios para disfrutarlas, se publicarán en la Plataforma y podrán ser modificados o eliminados en cualquier momento por parte de SENIORS FIRST a su exclusiva discreción, sin que las modificaciones o eliminaciones afecten a las promociones o bonos ya obtenidos por los Usuarios con anterioridad a su publicación. En caso de que se prevea una fecha de caducidad, los Usuarios deberán consumir los bonos y promociones antes de la fecha prevista a tal efecto, tras la cual dichos bonos o promociones se eliminarán de la cuenta del Usuario.
- Verificación de experiencia y valoraciones: Los Usuarios Contratantes tendrán la posibilidad de verificar y valorar experiencias que hayan tenido con Usuarios Cuidadores, a cuyo efecto podrán recibir notificaciones con encuestan en las que podrán verificar y manifestar dichas experiencias. A partir de las verificaciones y valoraciones de los Usuarios Contratantes y de otros empleadores anteriores de los Usuarios Cuidadores, la Plataforma podrá asociar un rating o calificación a los Usuarios Cuidadores que podrá influir en la posición en que sus perfiles son mostrados en las búsquedas de los Usuarios Contratantes. Asimismo, dichas valoraciones y verificaciones podrán ser reflejadas en determinados casos mediante símbolos en los perfiles de los Usuarios Cuidadores que indiquen a los Usuarios Contratantes si aquéllos cuentan con valoraciones y verificaciones positivas.
SENIORS FIRST es una Plataforma digital y no participa de la efectiva contratación entre el Usuario Contratante y el Usuario Cuidador, en forma alguna.
Una vez el usuario ha adquirido cualesquiera créditos o productos en la Plataforma y abonado el pago a través de cualesquiera de las modalidades puestas a disposición de los Usuarios por SENIORS FIRST, ésta remitirá al propio Usuario un correo electrónico en el que se recogerá toda la información relativa a los créditos o productos adquiridos, su precio y los impuestos aplicables.
La Plataforma utiliza una pasarela de pago segura proporcionada por “Stripe” que garantiza la integridad y seguridad de las comunicaciones y transacciones según lo dispuesto en los términos y condiciones de “Stripe” en cada jurisdicción que se haga uso de la misma, los cuales el Usuario reconoce y acepta de pleno derecho al aceptar los presentes TyCG.
Se deja expresa constancia de que, en relación a las transacciones no europeas, “Stripe” podrá aplicar comisiones adicionales y/o diferentes que correspondan al proveedor de “Stripe” relativo a cada jurisdicción donde se esté utilizando dicha metodología de pago.La adquisición de créditos y productos sólo será efectiva cuando SENIORS FIRST reciba confirmación del pago por parte de la referida plataforma de pagos. Si la transacción resultase por algún motivo denegada por dicha entidad, o no se aportase la cantidad íntegra correspondiente al importe de los créditos o productos (incluidos recargos por gastos de gestión y comisiones de transferencia bancaria), la contratación se suspenderá, informando al Usuario de que la transacción no ha sido finalizada.
Una vez recibido el pago completo, SENIORS FIRST remitirá la factura correspondiente a la contratación realizada al correo electrónico del Usuario. Mediante la aceptación de los presentes TyCG, el Usuario manifiesta su consentimiento expreso a recibir la factura electrónicamente. Si el Usuario desea la factura en papel, puede ponerse en contacto con SENIORS FIRST indicando la dirección postal a la que se deberá enviar la factura.
Asimismo, conforme a la legislación vigente, SENIORS FIRST no podrá modificar posteriormente la facturación de las ventas realizadas. Por ello, la factura se emitirá a nombre de la persona física que contrate los Servicios o adquiera los créditos o productos, por lo que el Usuario deberá asegurarse de realizar el pedido al nombre correcto, no pudiéndose emitir facturas duplicadas para enviárselas a terceros.
El Usuario se obliga a abstenerse de utilizar la Plataforma con fines o efectos ilícitos o contrarios a lo establecido en los TyCG.
SENIORS FIRST ofrece al Usuario acceso a la Plataforma conforme a una licencia limitada, no exclusiva, no sublicenciable, no transferible y revocable. El uso de la Plataforma será en todo momento personal y conforme a los presentes TyCG.
El Usuario, al hacer uso de la Plataforma, otorga expresamente a SENIORS FIRST y a sus afiliadas un derecho perpetuo, irrevocable, mundial, no exclusivo, libre de regalías y totalmente sublicenciable y una licencia para usar, reproducir, modificar, adaptar, publicar, traducir, distribuir, realizar y mostrar los contenidos que publique en la Plataforma.
Si el Usuario tuviera conocimiento de la existencia de algún contenido ilícito, ilegal, contrario a las leyes o que pudiera suponer una infracción de derechos de propiedad intelectual y/o industrial, deberá notificarlo inmediatamente a SENIORS FIRST para que ésta pueda proceder a la adopción de las medidas oportunas.
Queda expresamente prohibida la utilización de la Plataforma para fines distintos a los recogidos en los presentes TyCG. Por tanto, SENIORS FIRST no se responsabiliza de ningún uso o manipulación inadecuada de la Plataforma.
La Plataforma puede proporcionar acceso a multitud de textos, gráficos, dibujos, diseños, códigos, software, fotografías, imágenes, expresiones e informaciones pertenecientes a SENIORS FIRST o a terceros a los que el Usuario pueda tener acceso. El Usuario asume la responsabilidad del uso de la Plataforma y se compromete a hacer un uso lícito, diligente, honesto y correcto de cuanta información o contenidos tenga acceso a través de la Plataforma, y todo ello bajo los principios de la buena fe y respetando en todo momento a la legalidad vigente y los presentes TyCG.
Con carácter enunciativo, pero no limitativo, los Usuarios no deberán:
- Registrarse o comunicar datos que no sean verdaderos, exactos, completos y/o actualizados, ni acceder a la Plataforma utilizando el nombre, datos identificativos o las claves de acceso de otro Usuario o suplantar a cualquier persona o identidad. Asimismo, el Usuario se hace responsable de comunicar a SENIORS FIRST cualquier modificación y/o variación de cualquiera de los datos comunicados a SENIORS FIRST.
- Provocar ni maliciosa ni intencionadamente daños o perjuicios que puedan menoscabar, alterar la Plataforma, ni tampoco introducirá, ni difundirá virus informáticos que puedan producir alteraciones no autorizadas de los contenidos o sistemas integrantes de la Plataforma. El Usuario no deberá escanear o poner a prueba la vulnerabilidad de cualquier sistema o red de SENIORS FIRST, o infringir cualquier medida de seguridad o autentificación, así como tratar de descifrar o desensamblar el software utilizado por SENIORS FIRST para ofrecer los servicios a través de la Plataforma.
- Utilizar la Plataforma con fines fraudulentos, o relacionados con delitos penales o actividades ilícitas de ningún tipo.
- Reproducir, copiar, distribuir, transformar o modificar la información y los contenidos alojados en la Plataforma, a menos que cuente con la autorización del titular de los correspondientes derechos.
- Utilizar la Plataforma para enviar, usar o reutilizar material que contenga información ilegal, ofensiva, pornográfica, abusiva, indecente, difamatoria, obscena o amenazante de ningún tipo, o que suponga una violación de derechos de autor, marcas registradas o confidencialidad, privacidad o cualquier otro derecho, o sea de otro modo injurioso o censurable para terceras partes, o cuyo contenido contenga virus informáticos, propaganda política, contenido publicitario y, en general, cualquier tipo de molestia o inconveniente innecesario.
- Descargar, enviar o distribuir de cualquier otra forma contenidos o aplicaciones que puedan vulnerar cualquier legislación en vigor o que supongan infringir cualquier derecho de cualquier parte.
- Promover o fomentar que terceros lleven a cabo cualesquiera de las prácticas anteriores o contribuyan a ello.
- Enviar y/o subir:
- Material difamatorio para cualquier persona.
- Cualquier material obsceno, ofensivo, difamatorio.
- Cualquier material sexualmente explicito.
- Cualquier material que promueva la violencia.
- Cualquier material que promueva la discriminación por motivos de raza, sexo, religión, nacionalidad, discapacidad, orientación sexual o edad.
- Cualquier derecho de autor, derecho de bases de datos o marca comercial de cualquier otra persona.
- Los derechos de privacidad de cualquier otra persona.
- Los datos personales de otra persona, a menos que se asegure de que esa persona haya consentido en obligarse por los presentes TyCG.
- Cualquier material que promueva cualquier actividad ilegal.
- Amenazas, abusos, o invasión a la privacidad de otra persona.
- Contenido que cause molestias, inconvenientes o ansiedad innecesaria
- Acosos, molestias, o contenido que avergüence, alarme o moleste a cualquier otra persona.
- Contenido por el cual se suplante la identidad de otra persona.
Cualquier contenido que el Usuario suba y/o envíe a través de la Plataforma será considerado no confidencial y SENIORS FIRST tiene el derecho de usar, copiar y revelar a terceros dicho contenido para los propósitos predispuestos, siempre que lo permita la legislación aplicable. SENIORS FIRST tiene el derecho de revelar la identidad del mismo a cualquier tercero que reclame que cualquier contenido enviado constituye una violación de sus derechos de propiedad intelectual, o su derecho de privacidad.
SENIORS FIRST no se hará responsable ante terceros del contenido o la exactitud de cualquier contenido enviado. SENIORS FIRST tiene el derecho a eliminar cualquier contenido o anuncio enviado a través de la Plataforma a su total discreción, en la máxima medida permitida por la legislación aplicable.
SENIORS FIRST tendrá derecho a investigar y denunciar cualquiera de las conductas mencionadas de acuerdo con la Ley y los presentes TyCG, así como a colaborar con las autoridades en la investigación de dichas actuaciones.
La Plataforma (sitio web y app) incluyendo a título enunciativo, pero no limitativo, su programación, edición, compilación y demás elementos necesarios para su funcionamiento, los diseños, logotipos, textos y/o gráficos son propiedad de SENIORS FIRST.
Los Usuarios reconocen que la reproducción, modificación, distribución, comercialización, descompilación, desensamblado, utilización de técnicas de ingeniería inversa o de cualquier otro medio para obtener el código fuente, transformación o publicación de cualquier resultado de pruebas de referencias no autorizadas de cualquiera de los elementos y utilidades integradas dentro del desarrollo constituye una infracción de los derechos de propiedad intelectual de SENIORS FIRST, obligándose, en consecuencia, a no realizar ninguna de las acciones mencionadas.
Todos los contenidos de la Plataforma se encuentran debidamente protegidos por la normativa de Propiedad Intelectual e Industrial. Independientemente de la finalidad para la que fueran destinados, la reproducción total, parcial, uso, explotación, distribución y comercialización requiere en todo caso de la autorización previa, expresa y por escrito por parte de SENIORS FIRST.
Los diseños, logotipos, textos y/o gráficos ajenos a SENIORS FIRST y que pudieran aparecer en el sitio web o en la aplicación, pertenecen a sus respectivos propietarios, siendo ellos mismos responsables de cualquier posible controversia que pudiera suscitarse respecto a los mismos.
Los terceros titulares de derechos de propiedad intelectual e industrial sobre fotografías, logotipos, y cualesquiera otros símbolos o contenidos incluidos en La Plataforma han concedido las correspondientes autorizaciones para su reproducción, distribución y puesta a disposición del público.
Los servicios de SENIORS FIRST pueden estar integrados con aplicaciones, sitios web y servicios de terceros (Aplicaciones de Terceros) para poner a disposición de los Usuarios sus productos, servicios y contenidos. Estas Aplicaciones de terceros pueden tener sus propios términos y condiciones de uso y políticas de privacidad, que el Usuario se compromete a consultar, rigiéndose por estas el uso hagan los Usuarios de las mismas. Los Usuarios entienden y aceptan que SENIORS FIRST no se responsabiliza del comportamiento, características o contenido de las Aplicaciones de Terceros empleadas en la Plataforma, así como cualquier transacción ajena al ámbito de actividad de SENIORS FIRST que pueda realizar con el proveedor de dichas Aplicaciones de Terceros.
SENIORS FIRST no es responsable de la información, archivos o cualquier otro contenido que publiquen los Usuarios, ni valida los contenidos que los Usuarios o decidan remitir, por lo que SENIORS FIRST no será responsable, ni directa ni indirectamente, ni subsidiariamente, de los daños y perjuicios de cualquier naturaleza derivados de las comunicaciones realizadas o contenidos incluidos en la Plataforma.
La aceptación de las ofertas de los Usuarios por parte de otros Usuarios no supone la efectiva contratación de los servicios ofrecidos por los Usuarios. De este modo, SENIORS FIRST no asume ninguna responsabilidad en relación con las contrataciones que puedan efectuarse entre los Usuarios, limitándose la responsabilidad de SENIORS FIRST a la puesta a disposición de la Plataforma que permite a los Usuarios interactuar entre sí.
A título enunciativo SENIORS FIRST no se responsabiliza de:
- La satisfacción de las necesidades o exigencias personales del Usuario en relación con los recursos provistos por la Plataforma.
- La satisfacción de las experiencias de los Usuarios como consecuencia de las contrataciones que puedan tener lugar entre los Usuarios Contratantes y los Usuarios Cuidadores.
- Los daños directos o indirectos y/o intangibles, incluyendo las lesiones personales sufridas como consecuencia de un mal uso de la Plataforma.
- La pérdida de reputación, imagen, o datos, que pudiera ocurrir durante el uso de la Plataforma.
- La falta de disponibilidad, mantenimiento y efectivo funcionamiento de la Plataforma, excluyéndose, en la máxima medida permitida por la legislación vigente, cualquier responsabilidad por los daños y perjuicios de toda naturaleza que puedan deberse a la falta de disponibilidad o de continuidad del funcionamiento de la Plataforma.
- Cualquier defecto, error o problema de funcionamiento de la Plataforma.
En consecuencia, SENIORS FIRST no garantiza que el uso que los Usuarios puedan hacer de los contenidos y servicios que en su caso se incluyan en la Plataforma, se ajusten a los presentes TyCG, ni que lo hagan de forma diligente. SENIORS FIRST no puede garantizar la identidad de ningún otro Usuario de la Plataforma.
Los Usuarios se comprometen a no publicar en la Plataforma datos total o parcialmente falsos o inexactos y exoneran íntegramente de responsabilidad a SENIORS FIRST por cualquier falta de veracidad o exactitud de los datos publicados por los Usuarios en la Plataforma.
SENIORS FIRST se reserva el derecho de admisión y de exclusión de su Plataforma a su libre elección. En concreto, cualquier Usuario que no cumpla las normas contenidas en el presente condicionado o realice un uso inapropiado de la Plataforma podrá ser excluido de la misma.
SENIORS FIRST se reserva el derecho de (i) eliminar, suspender, editar o modificar el contenido de la Plataforma a su entera discreción, en cualquier momento, sin previo aviso y por cualquier motivo, y (ii) eliminar, suspender o bloquear cualquier uso que haga el Usuario de la Plataforma.
SENIORS FIRST también se reserva el derecho de leer, preservar, revelar y acceder a cualquier información que considere razonablemente necesaria para (i) cumplir con la legislación aplicable o cualquier requerimiento o solicitud judicial o gubernamental, (ii) hacer cumplir los presentes TyCG, incluyendo la investigación de potenciales infracciones a las mismas, (iii) detectar, prevenir o gestionar problemas de fraude, de seguridad o técnicos (iv) responder a solicitudes de asistencia al Usuario o (v) proteger los derechos, propiedad o seguridad de SENIORS FIRST y sus Usuarios.
No obstante, SENIORS FIRST declara que ha adoptado todas las medidas necesarias, dentro de sus posibilidades y del estado de la tecnología, para garantizar el funcionamiento de la Plataforma y evitar la existencia y transmisión de virus y demás componentes dañinos a los Usuarios.
- Responsabilidades legales del Usuario ante SENIORS FIRST
En ningún caso SENIORS FIRST será responsable de los daños y/o perjuicios y/o pérdidas de cualquier índole que los Usuarios pudieran sufrir como consecuencia o en ocasión de la contratación entre ellos, así como tampoco será responsable por los términos de contratación pactados entre el Usuario Cuidador y el Usuario Contratante.
SENIORS FIRST consiste únicamente en ofrecer una Plataforma que facilite el encuentro entre el Usuario Cuidador y Usuario Contratante a fin de realizar el servicio de vinculación entre las Partes. Asimismo el Usuario Contratante al aceptar el servicio prestado por el Usuario Cuidador a través de la Plataforma de SENIORS FIRST, acepta y reconoce que SENIORS FIRST no se responsabiliza por ningún acto cometido por los Usuarios y/o por terceros, incluyendo estos pero no limitándose a desistimientos de contrataciones de los servicios prestados por el Usuario Cuidador o la cancelación de dichos servicios, demoras, perdidas, falta de la matriculación correspondiente para el ejercicio de la profesión, y otros. Los Usuarios aceptan que han de tener conocimiento y que aprueban que al utilizar los servicios que ofrece la Plataforma deben asumir bajo su exclusiva responsabilidad, los riesgos que esta conlleva. - Suspensión y cancelación de los servicios
SENIORS FIRST podrá suspender temporalmente y sin previo aviso, la accesibilidad a la Plataforma con motivo de operaciones de mantenimiento, reparación, actualización o mejora.
Especialmente, SENIORS FIRST se reserva el derecho a eliminar, limitar o impedir el acceso a su Plataforma cuando surjan dificultades técnicas por hechos o circunstancias ajenos a SENIORS FIRST que, a su criterio, disminuyan o anulen los niveles de seguridad estándares adoptados para el adecuado funcionamiento de la Plataforma.
SENIORS FIRST no se responsabiliza de la falta de disponibilidad, mantenimiento y efectivo funcionamiento de la Plataforma excluyéndose, en la máxima medida permitida por la legislación vigente, cualquier responsabilidad por los daños y perjuicios de toda naturaleza que puedan deberse a la falta de disponibilidad o de continuidad del funcionamiento de la Plataforma, así como también de la efectiva prestación del servicio por parte del Usuario Cuidador.
SENIORS FIRST tampoco asume responsabilidad por la cancelación o suspensión de servicios en la Plataforma por causas que no le sean imputables. En todo caso, SENIORS FIRST se compromete a solucionar los problemas que puedan surgir y a ofrecer todo el apoyo necesario al Usuario Contratante para llegar a una solución rápida y satisfactoria de la incidencia. - Fuerza mayor
SENIORS FIRST no se responsabiliza de los casos de fuerza mayor, entendidos tales como el fallo, suspensión o interrupción de los servicios o utilización de la Plataforma, como consecuencia de bloqueo de la red de Internet, acciones u omisiones de terceras personas, o cualesquiera otras causas o circunstancias independientes de la voluntad de SENIORS FIRST que impidan la utilización normal de la Plataforma. - Hipervínculos
La Plataforma puede contener hipervínculos que permitan al Usuario acceder a plataformas o sitios web de terceros. SENIORS FIRST no asume ninguna responsabilidad por el contenido, informaciones o servicios que pudieran aparecer en dichas plataformas, que se entenderán ofrecidos exclusivamente con carácter informativo por parte de SENIORS FIRST, y que en ningún caso implican relación, aceptación o respaldo alguno entre SENIORS FIRST y las personas o entidades titulares de tales contenidos o titulares de los sitios donde se encuentren.
En estos casos, SENIORS FIRST no será responsable de establecer los términos y condiciones generales y particulares a tener en cuenta en la utilización, prestación o contratación de estos servicios por terceros y, por lo tanto, no podrá ser considerado responsable de los mismos.
SENIORS FIRST no tiene facultad ni medios humanos ni técnicos para conocer, controlar ni aprobar toda la información, contenidos, productos o servicios facilitados por otras páginas web a las que se puedan establecer enlaces desde la Plataforma. En consecuencia, SENIORS FIRST no podrá asumir ningún tipo de responsabilidad por cualquier aspecto relativo a las páginas web a las que se pudieran establecer un enlace desde la Plataforma, en concreto, a título enunciativo y no taxativo, sobre su funcionamiento, acceso, datos, información, archivos, calidad y fiabilidad de sus productos y servicios, sus propios enlaces y/o cualquiera de sus contenidos, en general.
No obstante, en caso de que SENIORS FIRST llegue a tener conocimiento efectivo de que la actividad o la información a la que se remite desde dichos enlaces es ilícita, constitutiva de delito o puede lesionar bienes o derechos de un tercero, actuará con la diligencia necesaria para suprimir o inutilizar el enlace correspondiente con la mayor brevedad posible.
Los Usuarios mantendrán indemne, defenderán y exonerarán a SENIORS FIRST de todo daño, responsabilidad y costo que pudiera surgir como consecuencia de un reclamo de terceros contra SENIORS FIRST, y/o sus directivos y/o representante y/o empleado de cualquier cargo, acción o demanda, incluyendo, pero no limitándose a los gastos legales razonables, que resulten de cualquier material que ellos hayan proporcionado a SENIORS FIRST mediante cualquier uso indebido de los servicios que SENIORS FIRST provee o en violación de estos TyCG. SENIORS FIRST les notificará puntualmente de cualquier demanda, acción o proceso a través de los datos que ellos mismos hayan suministrado al momento del alta en los servicios que la Plataforma de SENIORS FIRST ofrece. Mediante la aceptación de los presentes TyCG los Usuarios reconocen y aceptan que SENIORS FIRST no tiene responsabilidad directa o indirecta en relación a los servicios contratados entre el Usuario Cuidador y cada Usuario Contratante y/o con terceros.
Se entienden como vigentes, las condiciones que estén publicadas en el momento en el que el Usuario acceda a la Plataforma de SENIORS FIRST.
Si alguna disposición de los presentes TyCG se declarase inaplicable o inválida, dicha disposición será limitada o eliminada en la medida mínima necesaria para que las restantes condiciones y obligaciones permanezcan en pleno vigor y efecto y de obligado cumplimiento.
SENIORS FIRST podrá suprimir, modificar o sustituir los contenidos del presente documento en cualquier momento, publicando o enviando una notificación a través de la Plataforma o por correo electrónico, sin posibilidad por parte del Usuario de exigir indemnización alguna por ello.
SENIORS FIRST respeta la privacidad de sus Usuarios y se asegurará de que los datos personales sean tratados de acuerdo con la legislación vigente.

SENIORS FIRST puede traducir los presentes TyCG o cualquier otra política que pueda ser publicada en la Plataforma. La versión en español será la que prevalezca en caso de conflicto con otras traducciones.
Para la resolución de cualquier discrepancia, cuestión o reclamación derivada directa o indirectamente de la interpretación o ejecución de los presentes TyCG, las partes renuncian al fuero propio que pueda corresponderles y se someten a la jurisdicción de los Juzgados y Tribunales de la ciudad del domicilio del Usuario.
En virtud de lo dispuesto en el Reglamento (UE) nº 524/2013 del Parlamento Europeo y del Consejo, de 21 de mayo de 2013, relativo a la resolución de litigios en línea en materia de consumo, SENIORS FIRST le informa que, en caso de controversia, los Usuarios residentes de la Unión Europea podrán acudir a la “Plataforma Online de Resolución de Conflictos” que ha desarrollado la Comisión Europea, con el fin de intentar resolver extrajudicialmente cualquier controversia que se derive de la prestación de servicios por parte de SENIORS FIRST.

TERMS AND CONDITIONS OF USE OF «SENIORS FIRST»
These General Terms and Conditions (henceforth the “TyCG”) regulate the download, access, navigation and use of the mobile application SENIORS FIRST and the website https://caregivers.seniorsfirst.care (hereinafter, jointly named, the “Plataform”).
These TyCG are aimed both at registered users on the Platform and at any other user who accesses, browses or uses the Platform in any way.
In compliance with the duty of information contained in article 10 of Law 34/2002, of July 11, on Services of the Information Society and Electronic Commerce, we detail below the data of the owner of the Platform:

SENIORS FIRST only provides the Platform to bring both the User who offers its services on the Platform (hereinafter, the «User» and / or the «Carer User») and the User who publishes job offers on the Platform and is interested in contract such services (hereinafter, the «Contracting User» and, together with the «Caregiver User», the «Users»).
It is expressly stated that SENIORS FIRST only makes available to its Users, through the Platform, a virtual linking space (hereinafter, the «Service»).
In the event that one or more Users or any third party initiate any type of claim or legal action against any User, each and every one of those involved in said claims or actions exempts SENIORS FIRST and its directors, managers, employees, from all liability. agents, operators, representatives and attorneys-in-fact.
The Service is limited to the provision of a technological platform that allows its Users to be linked immediately and thus be able to supply the needs of some with the services of the counterpart.
Therefore, SENIORS FIRST does not assume any responsibility beyond the aforementioned link between Users through the Platform.
The Contracting User knows and accepts that when carrying out operations with other Users or third parties, they do so at their own risk and responsibility, and that they will make an assessment of the risks incurred when contracting the services offered by the chosen Caretaker User, keeping the due ratio between risk and selected medium.
The agreement and relationship between the Users does not create any partnership, mandate, franchise or employment relationship between SENIORS FIRST and the Users. The Users acknowledge and accept that SENIORS FIRST is not a party to any operation, nor does it have any control over the quality, safety or legality of the services required, or the capacity or suitability of the Caregiver User to provide said services.
The TyCG, as well as the Privacy Policies and / or information on the Platform apply to all Users of the Platform from the first moment in which they access it. These TyCG are mandatory, binding and are applicable to all activities carried out on the Platform. If Users do not wish to fully submit to the provisions of these T&C and the Privacy Policies, they must refrain from using the Platform.
Users are responsible for ensuring that all persons who access the Platform through their internet connection are aware of and comply with the TyCG. dataprotection@seniorsfirst.co.uk
SENIORS FIRST declares and states that it makes the Service of a technological platform available which allows its Users to link with each other and bring the social health care service offered by the Caregiver User to the Contracting User and / or the request of any Contracting User of said services.
Users declare that said intervention and / or link through the Platform will not generate for Users any type of employment relationship with SENIORS FIRST.
By accepting the TyCG, Users undertake to act at all times in accordance with the provisions established in the clauses of this legal text. If they do not agree with all or part of these TyCG, Users must refrain from installing and using the Platform.
The service provided on this Platform is governed by: (i) these TyCG; (ii) Particular Conditions that may be published on the Platform; and (iii) current and applicable laws, sector regulations, and general criteria and practices.
By accepting these TyCGs, Users declare that they are over 18 years of age and have the full capacity to understand and accept the content of these TyCGs, as well as the legal capacity to contract and assume obligations.
SENIORS FIRST reserves the right to modify the presentation, configuration and content of the Platform, as well as the conditions required for its access and / or use. The access and use of the contents and services after the entry into force of their modifications or changes in the conditions imply the acceptance of them.
Access to certain content and the use of services may be subject to certain particular conditions that, depending on the case, will replace, complete and / or modify these TyCG and, in case of contradiction, the terms of the particular conditions will prevail over the TyCG.
Before using and / or requesting said specific services offered through the SENIORS FIRST Platform, Users must carefully read the particular conditions created, where appropriate, for this purpose by SENIORS FIRST. The use, reservation and / or request of said specific services, implies the acceptance of the particular conditions that regulate them in the version published by SENIORS FIRST at the time that such use, reservation and / or contracting occurs through the Platform.
The Platform has been developed by SENIORS FIRST with the purpose of providing a service of making available a technology Platform that allows its Users to link immediately and thus be able to supply the needs of one with the services of the counterpart.
The Contracting User may through the Platform access all the necessary information corresponding to it. From there you can browse and investigate in depth how it works.
- Record: In order to use the services of the Platform, it is necessary to register on it and accept these TyCG. Registration on the Platform is free. To register on the Platform, the Contracting User must create an account, providing their email, basic personal data and choose a password to access the Platform. In the event that the Contracting User uses the Platform with an associated payment plan, he or she must provide the billing and payment information. At the time of registration, the Contracting User must be at least eighteen (18) years old or the age of majority applicable in their place of residence. Users guarantee that their data will be accurate, current and truthful. SENIORS FIRST cannot guarantee the identity of registered Users, not being responsible for improper or unauthorized uses of a User registered by third parties. The registered Contracting User will be responsible at all times for the custody of his access password to his User account, consequently assuming any damages that may arise from its improper use, as well as the transfer, disclosure or loss of the same, and must inform SENIORS FIRST immediately if you have reason to believe that your access code or password has been used in an unauthorized manner or is likely to be. In any case, the access and / or use of the Platform made under the access code or password of the registered Contracting User will be deemed to have been made by said User, who will be responsible in all cases for said access and use. Once the Contracting User has created an account to access the Platform, he will have access to a profile where he can complete his personal data in accordance with the provisions of the Platform. SENIORS FIRST has the right to request some proof and / or additional data in order to corroborate the personal data of Users, as well as temporarily or permanently suspend the accounts of those Users whose data could not be confirmed, without generating the right to compensation in favor of said Users. SENIORS FIRST has the right to reject any application for registration or cancel a previously accepted registration, without being obliged to communicate or state the reasons for its decision and without generating the right to compensation and / or compensation in favor of the affected Users. Once the registration on the Platform has been correctly completed, the Contracting User will have access to a search engine in which they must select the filters offered to define the characteristics of the offer they wish to make. After selecting the desired filters, the Contracting User must select the preferred modality to make an offer from among those set out below.
- Find and Send Mode: By selecting this modality, the search engine will offer Contracting Users one or more results of Caregiver Users whose profiles match the selected search criteria. It is possible that the search engine forces you to select some basic basic filters to be able to offer results. In the event that there are no profiles matching the selected criteria, the Platform will recommend repeating the search by eliminating some of the selected filters and will offer the Contracting Users to carry out a personalized selection process by SENIORS FIRST. In this case, after completing the selection process, the Contracting User will receive the results and may decide to send a direct offer to the Career Users of their choice. In order to send a direct offer to any of the Caregiver Users shown in the results list, the Contracting User must have at least one (1) sufficient credit or bonus. Having at least one (1) credit, the Contracting User may send direct offers to as many Caregiver Users as he wishes. However, at the moment in which one of the Caregiver Users accepts the offer, the Contracting User will not be able to see subsequent acceptances from other Caregiver Users who also wish to accept the offer if they do not have one (1) credit for each additional acceptance that want to view. The direct offers that the Contracting User sends to each Caregiver User will expire within twenty-four (48h) hours from their dispatch. For each Caregiver User who accepts the offer received from the Contracting User, one (1) of the credits that the Contracting User has available at that time will be consumed. In the event that they do not have sufficient credits at that time, the Contracting User will not be able to receive the acceptances until they have acquired new credits in sufficient quantity. It is also possible that Caregiver Users who have received a direct offer show their interest in it, but conditioning their acceptance in relation to some aspect of the offer (eg, start date, schedule, salary, etc.). In this case, the Contracting User will receive a notification informing him of the interest expressed by the Caregiver User and will have the possibility of consuming one (1) credit to be able to initiate a connection with said Caregiver User and comment on the condition expressed by the Caregiver User. In case of not having sufficient credits, the Contracting User will not be able to initiate said connection. In case of rejection of the offer by the selected Caregiver User, the credit that the Contracting User had available will not be consumed, so they can continue to use it for new offers to other Caregiver Users, in accordance with the provisions herein.
- Post mode (Post an offer): By selecting this modality, once the desired filters or criteria have been selected (some of which may be required), the Platform will publish the Contract User’s offer on the wall or profile of those Caregiving Users that match the selected search criteria. by the Contracting User. The publication of the offer under this modality will have no cost for the Contracting Users. The offers thus published will expire within thirty (30) calendar days, which the Contracting User may extend for another thirty (30) calendar days. The Caregiver Users who receive the offers from the Contracting Users will have the option to register for said offer. In this case, the Contracting User will receive a notification informing him that a Caregiver User has registered in his offer and will have the option of consulting his profile. In the event that he wishes to initiate a connection with the Caregiver Users registered in his offer, the Contracting User must consume one (1) credit for each Caregiver User with whom he wishes to connect. Likewise, the Contracting User will have the possibility to delete the offer, duplicate it or edit it at any time.
- Post (Publish an offer) and Find and Send (Direct Search) mode: The Contracting Users may also select at the same time the two modalities that have just been exposed, in which case their offer will be published on the wall or profile of the Caregiver Users under the conditions set out in the previous section and, likewise, they will obtain the results of the profiles of the Caregiver Users that match your search criteria, to which you can send a direct offer under the conditions set out in section 4.2.
- Credits: Users may acquire credits on the Platform by paying the price published on the Platform at the time of acquisition. The current price of the credits and products available on the Platform will be the one indicated at all times on the Platform together with its description, being publicly accessible to view it. All prices are shown in euros (except for contracting in the United Kingdom, in which prices will be shown in pounds sterling -GBP-), unless expressly stated otherwise. The price shown is the final price, expressly including the Value Added Tax (VAT) and any other applicable expenses. The Platform uses a secure payment gateway provided by «Stripe» that guarantees the integrity and security of communications and transactions as provided in the terms and conditions of «Stripe» in each jurisdiction that uses it, which the User acknowledges and fully accepts by accepting these TyCG.
